Getting your security deposit back
January 5, 2025
Landlords keep $1.5 billion in security deposits every year. Most of it illegally. Here's how to fight back.
Why landlords keep deposits
They know most tenants won't fight. Small claims court takes months. Lawyers cost more than the deposit. So they invent damage charges and keep your money.
What the law says
Normal wear and tear isn't damage. They can't charge you for carpet that was already worn. Or paint that faded from sunlight. Most jurisdictions require itemized lists within 30 days. Many landlords don't follow the rules.
How to fight back
Document everything with photos when you move in and out. Get a second opinion on whether the charges are legitimate. Send the landlord a formal demand letter with evidence. Most back down when you show you're serious.
Skip small claims court
Filing fees, time off work, no guarantee you'll win. Use an online dispute resolution platform instead. Upload your photos and move-in/move-out records. Invite the landlord to respond. Get neutral analysis. Resolve it in days, not months.
